New resolution on the legends andimages to be displayed on tobacco product packages

On May 17, 2024, the “Decree by which the series of legends, images, pictograms, health messages, and information that must appear on all tobacco product packages and all external packaging and labeling thereof, to be applied as of September 1, 2024 and until June 30, 2026” (the “Decree”) was published in the Federal Official Gazette.

RELEVANT ASPECTS OF THE DECREE

The Decree is applicable to every brand of tobacco products manufactured, produced, or imported and distributed within the national territory, without favoring one brand over another.

The health messages and pictograms referred to in the Decree are distributed in quarterly cycles with different pictograms and messages for each specific period, including warnings about the harmful effects on health derived from tobacco consumption, ensuring their rotation and equal proportion among all tobacco brands.

In addition, special reference is made to the fact that companies producing tobacco products will be solely responsible for ensuring that the legends, images, pictograms, health messages, and

information of this Agreement are used and applied in a timely and correct manner, complying at all times with the deadlines referred to. Therefore, such companies must plan their printing program in alignment with their production and, thus, comply with the provisions referred to in the Decree.

In the case of the importation of tobacco products, the companies involved in this activity will be solely responsible for planning the necessary printing program for the conditioning of packages, external packaging, and labeling. The above, in order to ensure that the tobacco products comply with the in-force provisions at the time of requesting the import permit from the Federal Commission for Protection against Sanitary Risks (“COFEPRIS” for its acronym in Spanish).

ENTRY INTO FORCE

The Decree shall enter into force on September 1, 2024, and shall remain in force until June 30, 2026.
