On June 21, 2023, the Draft of Mexican Official Standard PROY-NOM-017-ASEA-2023 (hereinafter the “Draft”) was published in the Federal Official Gazette (“DOF” for its acronym in Spanish). The purpose of the Draft published by the National Agency for Industrial Safety and Environmental Protection of the Hydrocarbons Sector (“ASEA” for its acronym in Spanish) is to regulate Liquefied Petroleum Gas (“LP Gas”) storage facilities.
The Draft is aimed at minimizing risks in the handling of LP Gas, its main purpose will be to anticipate, supervise and reduce accidents in this critical sector.
Implementations
The main objective of the Draft is the integral regulation of Liquefied Petroleum Gas storage facilities in the country and will be achieved through the complete renewal of the existing regulations, taking into consideration aspects such as the design, construction, operation, and maintenance of such facilities. The Draft would replace the NOM-015-SECRE-2013 and, if approved, would establish more rigorous design and operation criteria, to minimize the risks inherent to the handling of LP Gas.
The Draft is currently in the public consultation stage, which is why it has not yet entered into force. If the Draft is approved by Congress, the implementations will be mandatory for all operators engaged in land or maritime storage of LP Gas and transportation of this resource, if they use reception, storage, and delivery facilities as part of their operations.
Conclusions
Interested parties should be aware of this important development and consider actively participating in the public consultation to influence the final version of the standard, as it will be open to suggestions for 60 days after its publication date, so it is advisable to seek legal advice in case of any doubts or concerns about this Standard.
