Memorandum of Understanding between the State of Texas and the Free and Sovereign State of Nuevo León
Memorandum of Understanding made by and between the State of Texas and the Free and Sovereign State of Nuevo León (hereafter “Memorandum”). The State of Texas is referred to as “Texas”, the Free and Sovereign State of Nuevo León is referred to as “Nuevo León”, individually, each party may be referred to as a “State”; and collectively, the parties are referred to as “States.”
Whereas, the States have a mutual interest in ensuring that their shared border is secure; and
Whereas, Texas anticipates a significant rise in cartel-facilitated smuggling through the use of unsafe vehicles due to President Biden’s decision to end Title 42 expulsions; and
Whereas, Texas has implemented enhanced safety inspections of vehicles as they cross international ports of entry to reduce the number of unsafe vehicles that enter Texas; and
Whereas, these inspections -which have revealed that almost 25% of the vehicles that crossed into Texas were unsafe- have slowed border crossings for commercial vehicles; and
Whereas, given the importance of trade between Texas and Nuevo León, it is in the best interests of the States to enter into this Memorandum;
Now, therefore, be it resolved that Texas and Nuevo León will reduce the number of threats to the public by vehicles approaching the border, and the corresponding need for enhanced safety inspections, by using their best efforts as follows:
- The States will work cooperatively to ensure that vehicles crossing an international port of entry meet the safety standards applicable in each State.
- The States will work cooperatively to reduce the carters’ human trafficking and smuggling of deadly fentanyl and other drugs across and between ports of entry.
- The States will work cooperatively to stem the flow of migrants from over 100 countries who illegally enter Texas through Nuevo León.
- Nuevo León has begun and will continue enhanced border security enforcement measures on the Nuevo León side of the border, both at ports of entry and along the Rio Grande River, to prevent illegal immigration from Nuevo León into Texas.
- The States will work cooperatively to restore the border-crossing inspections process to allow crossings at a faster pace.
This Memorandum may be modified by mutual consent of the States in writing. Notwithstanding any other provision in this Memorandum, the Memorandum may be terminated by either State upon written notice thirty days before the date of termination.
